That's what most (all?) people actually get fucked for in the courts. They can't prove without access to your ISP logs what you've been downloading, but it's relatively easy to get people for uploading. Common sense suggests that if you're going to go for a target, go for the people who are uploading the stuff, not downloading the stuff.

Either way, I await the release of the next mass p2p client that deals with some of the issues surrounding anonymity.
